By using Monocube LLC's services, you agree to these terms. Please read them carefully.

These Terms of Service govern your use of Monocube LLC's products and services, including our SaaS Starter and SaaS Pro packages, custom development work, and consulting services.

Introduction

Thank you for choosing Monocube LLC. We've been building production-grade software since 2005, and we're committed to delivering exceptional products and services. These Terms of Service help us maintain a fair and transparent relationship with our clients.

Definitions

"Company", "we", "our", or "us" refers to Monocube LLC.

"Services" means our websites (including monocube.com), SaaS Starter and SaaS Pro packages, custom development work, consulting services, and any applications or products we create and deliver to you.

"You" or "your" refers to individuals or organizations that purchase or use our Services.

Updates to Terms

We may update these Terms of Service from time to time. When we make significant changes, we'll update the date at the top of this page and notify you via email if appropriate.

By continuing to use our Services after changes take effect, you agree to the updated Terms. These Terms contain a limitation of our liability, so please read them carefully.

If you violate these Terms, we may terminate your access to our Services. We do our best to deserve your trust by being transparent about who we are and how we work. Questions? Contact us.

Account Terms

  1. Account Security: You are responsible for maintaining the security of your account and password. We cannot be liable for loss or damage from your failure to maintain security. We recommend two-factor authentication for all accounts.
  2. Acceptable Use: You may not use the Services for any purpose outlined in our Use Restrictions policy.
  3. Account Responsibility: You are responsible for all content posted to and activity that occurs under your account.
  4. Human Users Only: Accounts must be registered by humans. Bot-created accounts are not permitted.

Payment, Refunds, and Pricing

  1. Fixed-Price Packages: Our SaaS Starter ($9,700) and SaaS Pro ($14,700) packages are one-time payments. Payment is due before we begin development.
  2. Refund Policy: If we fail to deliver production-ready code within the promised timeline (1 week for Starter, 2 weeks for Pro), you receive a full refund. No questions asked.
  3. Custom Development: Custom projects are quoted separately. We provide transparent estimates and invoicing. Hourly consulting is $300/hour.
  4. Taxes: All fees are exclusive of taxes, levies, or duties imposed by taxing authorities. Where required, we will collect and remit taxes. Otherwise, you are responsible for all taxes.

Code Ownership

You own the code. When you purchase SaaS Starter, SaaS Pro, or custom development, you receive complete ownership of the source code. No licensing fees. No restrictions. You can modify, sell, or white-label the code however you want.

We retain the right to reuse patterns, techniques, and general approaches from your project in future work, but we will never reuse your specific business logic or proprietary features.

Cancellation and Termination

  1. How to Cancel: For applications we've built that include account systems, you can cancel through your admin dashboard. Need help? Contact us.
  2. Data Deletion: Upon cancellation, your data becomes inaccessible immediately. Within 30 days, it's permanently deleted from active systems. Within 60 days, it's removed from backups. We cannot recover data after permanent deletion.
  3. Our Right to Terminate: We reserve the right to suspend or terminate access to our Services for violations of these Terms or our Use Restrictions policy.
  4. Zero Tolerance for Abuse: Any verbal, physical, written, or other abuse of Monocube employees will result in immediate termination.

Service Modifications

  1. Right to Modify: We reserve the right to modify or discontinue any part of our Services. For applications we've delivered to you, you own the code and can maintain it independently.
  2. Pricing Changes: We may change pricing for future customers. If we change pricing for existing customers (e.g., consulting rates), we'll provide at least 30 days notice via email.

Security and Privacy

  1. "As Is" Basis: Services are provided "as is" and "as available." We take uptime and reliability seriously, but we don't offer service-level agreements for most services.
  2. Data Security: We protect your data through encryption, backups, and redundancies. See our Privacy Policy for details on how we handle your information.
  3. When We Access Your Data: We may access your data to:
    • • Help with support requests (with your consent)
    • • Fix critical errors affecting automated processes
    • • Investigate abuse reports or security issues
    • • Comply with legal requirements
  4. Legal Compliance: As a US company, we only share customer data when compelled by legally binding orders from US authorities. We resist overly broad requests and only share the minimum necessary information.
  5. Third-Party Services: We use third-party vendors for hosting, infrastructure, and payment processing (e.g., Cloudflare, Stripe). These vendors are bound by their own privacy policies and terms.
  6. CCPA Compliance: Under the California Consumer Privacy Act, Monocube is a "service provider." We process your data only for the purposes you've authorized and as described in our Privacy Policy. We do not sell your data.
  7. GDPR Compliance: When EU or UK data protection regulations apply, these Terms incorporate our Data Processing Addendum (DPA).

Intellectual Property

Your Content: Any content you provide to us remains yours. You grant us a limited license to use it solely to provide services to you.

Code We Deliver: For SaaS Starter, SaaS Pro, and custom development, you own the code we deliver. Full ownership. No restrictions.

Our Website and Branding: You may not copy, reproduce, or reuse any portion of our website's HTML, CSS, JavaScript, or design elements without permission. To use our logos, please contact us.

Features, Bugs, and Warranties

We design our Services with care and test extensively before delivery. However, as with any software, bugs are inevitable. We make no guarantees that our Services will meet your specific requirements or be completely error-free.

We track reported bugs and prioritize fixes, especially for security and privacy issues. Not all reported bugs will be fixed, and we don't guarantee completely bug-free software.

That said: If we fail to deliver production-ready code within our promised timelines, you get a full refund. We've been doing this for 20 years. We deliver.

Limitation of Liability

Important Legal Notice: You understand and agree that Monocube LLC shall not be liable for any direct, indirect, incidental, lost profits, special, consequential, punitive, or exemplary damages resulting from:

  • • The use or inability to use the Services
  • • Unauthorized access to or alteration of your data
  • • Statements or conduct of third parties
  • • Any other matter relating to these Terms or the Services

In plain English: Choosing to work with us means you're placing trust in our 20 years of experience. We do everything we can to be worthy of that trust through careful work, robust security, and genuine care for your project.

But if something goes wrong that's outside our control, we can't be held liable for indirect damages. We can promise you our best work, but we can't guarantee perfection in an imperfect world.
